In our newest podcast, Attorney and GLCCA President-Elect John Ryan discusses the Facebook v. Duguid case, which is currently before the US Supreme Court. In this case, Facebook has appealed to the Supreme Court to rule on what constitutes an ATDS (automated telephone dialing system) as defined in the TCPA.

A preliminary brief filed by the Federal government states that they believe a predictive dialer (like those typically used by collection agencies) is NOT an ATDS as outlined in the TCPA, and that legislative history also supports that stance.

Attorney Ryan breaks down the history of the Facebook case, how the case may play out, and the impact a ruling may have on future use of predictive dialers within the collection industry.
